12月8日上午,上海市金山区组织新当选的区、镇两级人大代表近500人集中公开向宪法宣誓。这是金山区,也是上海市首次举行的全体人大代表宪法宣誓仪式。有人认为,这是增强代表宪法意识的创新之举;也有人认为,全国人大常委会关于宪法宣誓制度的决定不包括各级人大代表,法无授权不可为。那么,新当选的人大代表有必要向宪法宣誓吗?(安徽省芜湖市三山区人大常委会滕修福提供)
On the morning of December 8, nearly 500 people from the newly elected district and town people’s congress deputies in Jinshan District of Shanghai were sworn to the Constitution in a centralized manner. This is Jinshan District, which is also the first swearing-in ceremony for the constitution of the NPC deputies in Shanghai. Some people think that this is an innovative measure to enhance the sense of constitutional representation. Some people think that the NPC Standing Committee’s decision on the constitutional oath system does not include the deputies at all levels and that the law can not be used without authorization.
