近来众多公众人物代言的药品食品广告涉嫌虚假宣传,给消费者的人身或者财产造成了损害。美国以及欧洲等国对公众人物以及产品代言人作出了相关解释,在我国也引入了相关的概念,从而对该类广告中公众人物的法律地位进行了定性。公众人物作为产品品牌拥有者的雇佣人员,对于其代言的缺陷产品导致消费者的人身和财产损害应当与其他责任主体一同承担连带责任。
Recently many public figures endorsements of drug advertisements allegedly false propaganda, to the consumer’s personal or property damage. The United States and European countries made explanations on public figures and product spokespersons, and introduced relevant concepts in our country so as to define the legal status of public figures in such advertisements. Employers of public figures, who are the owners of product brands, should bear the joint and several liability with other responsible parties for the defective products of their endorsements that result in the loss of personal and property to consumers.
