随着计算机的商业化普及,计算机犯罪出现了新的发展态势,社会危害性越来越大,犯罪的技术性越来越强,全球化的程度越来越高。作为最后保障手段的刑事法规制面临着一系列的挑战,如立法的滞后性、传统犯罪概念的制约以及刑事执法的困难等。为了应对刑事法所面临的种种挑战,需要进一步提高立法技术;在刑事执法上,应以预防为主,惩罚为辅,综合运用多元手段预防和打击计算机犯罪;同时还要加强国际司法合作,通过国际社会的共同努力遏制计算机犯罪的发展势头。
