国际犯罪的刑事管辖机制主要包括国际管辖和国家管辖两个层面,从一国立场上看,这涉及本国与他国以及国际刑事司法机构的管辖权协调。为有力打击国际犯罪,国家应在维护本国司法主权、遵守条约义务和尊重国际刑事司法机构管辖权之间取得必要的平衡,设置和完善本国刑事管辖机制。在这方面,《罗马规约》对于一国刑事管辖机制的完善有着重要的指导意义。
The criminal jurisdiction mechanisms of international crimes mainly include international jurisdiction and national jurisdiction. From a national standpoint, this involves the coordination of jurisdiction of their own country and that of other international criminal jurisdictions. In order to effectively crack down on international crimes, the state should strike the necessary balance between safeguarding its own judicial sovereignty, observing treaty obligations and respecting the jurisdiction of the international criminal justice institutions, and setting and improving its own criminal jurisdiction mechanism. In this regard, the Rome Statute has an important guiding role in the improvement of the criminal jurisdiction mechanism of a country.
