一、商标滑稽模仿概述滑稽模仿,又称戏仿,最初产生于版权法领域,是一种独特的艺术表现形式。《布莱克法律词典》将滑稽模仿定义为:“对知名作品进行转换性使用,以达到对原作讽刺,嘲弄或批判的目的,而不是仅仅借用原作引起人们对新作品的注意”。~([1])也就说,构成版权法上的滑稽模仿应当满足以下几点:1、模仿的对象是知名作品;2、行为方式是转换性使用,既不是全部复制也不是
