承运人责任限额制度是指承运人因为不能免责之原因造成货物灭失、损坏、或延迟交付,承运人本应该全额赔偿损失,但是海上运输法律通过限定单位最高赔偿额的办法将承运人的赔偿责任限定在一定范围内的一种赔偿制度。它反映了船货双方的力量对比,直接关乎船货双方的利益。文章通过对比《海牙-维斯比规则》、《汉堡规则》和《鹿特丹规则》对承运人责任限额的规定,评价《鹿特丹规则》承运人责任限额规定的合理性和科学性,提出我国应该借鉴《鹿特丹规则》修改《海商法》下承运人责任限额制度。
