以权力和责任主体判断为归属的传统行政委托制度,缺乏有关行政任务何种条件下可委托完成的内容。行政法总论,尤其是行政组织法应当包含有关于行政任务委托行使的一般性配置规则。行政委托作为一种行政任务的履行手段,是达成行政目标“人的手段”向外的延伸。行政任务的属性对于其能否委托完成具有决定意义。对能否委托进行判断,首先需要从事务性质上确定任务系权力性还是服务性。如果是权力性任务,需进一步判断该“权力性”是形式还是实质上的;对于实质权力性行政任务,则需从纵向上观察分析,不包含权力性要素的准备和执行阶段事务也有委托的可能。
