罢工权是公民的一项权利,在法律上是否予以确认此项权利,各国要依其具体情况而定.我国自改革开放以来,社会政治经济环境已有了很大的变化.2001年2月我国全国人大批准了联合国《经济.社会及文化权利国际公约》,表明我国已经从法律上确认了公民的罢工权利.罢工权利的价值功能在于平衡劳资双方的力量、解决劳资双方的矛盾,以维护劳动者的合法权益.改善劳动者的工作条件和劳动报酬。为维护劳动者的合法权益,法律上应当对劳动者的罢工权予以确认,同时,为防止罢工权利的滥用.对罢工权进行适当的限制也是必要的.论文对这一问题进行了初步探讨.
The right to strike is a civil right, whether legally recognized this right, depending on the specific circumstances of each country. The value function of the right to strike is to balance the power of both employers and employees, to resolve the contradiction between employers and employees so as to safeguard the legitimate rights and interests of workers. Improve the working conditions and remuneration of workers. In order to safeguard the lawful rights and interests of laborers, the worker’s right to strike should be legally recognized, and at the same time, to prevent the abuse of the right to strike. Appropriate restrictions on the right to strike are also necessary. The paper has carried on the preliminary discussion to this question.
