我国民商事仲裁经过十年的发展已经取得了相当的成绩,但也面临着仲裁委员会性质模糊、受案数量普遍不足等问题,并已影响了我国仲裁事业发展的质量和效用的提高。对此,需要采取一系列的对应措施,包括:在立法上明确仲裁委员会的性质,逐步推进仲裁的机构改革;国家应当加大对仲裁机制的宣传和支持力度;调整仲裁员队伍的成分构成,提高仲裁员的整体素质;在重塑当事人意思自治理念的基础上完善我国《仲裁法》和仲裁规则;成立中国仲裁协会,规范对仲裁委员会和仲裁员的行业管理。
The civil and commercial arbitration in our country has achieved considerable success after ten years of development, but it also faces the problems of the fuzzy nature of the arbitration commission and the generally insufficient number of cases. It has affected the quality and effectiveness of the arbitration in our country. In this regard, a series of countermeasures should be taken, including: clarifying the nature of the arbitration commission in legislation and gradually promoting the institutional reform of arbitration; the state should step up publicity and support for arbitration mechanisms; adjust the composition of the arbitrators’ Improve the overall quality of arbitrators; improve China’s “Arbitration Law” and arbitration rules on the basis of reshaping the concept of party autonomy; and set up the China Arbitration Association to regulate the industrial management of arbitration commissions and arbitrators.
