在反垄断法中对垄断行为的违法性判断原则有两个,一个是本身违法原则,另一个是合理性原则。对反垄断法违法确认原则的研究有助于我们清楚认识什么样的行为构成垄断,什么样的行为应当受到反垄断法的规制。1890年美国通过谢尔曼法案,开始了一百多年的反垄断司法实践,其反垄断的违法确认原则也在实践中不断的调整适用,总结美国反垄断违法原则的历史变迁进程,有利于我国反垄断立法和司法实践借鉴及吸取经验教训。
In antitrust law, there are two principles for judging the illegality of monopolistic behavior, one is the principle of illegality and the other is the principle of rationality. The study of the principle of the unlawful affirmation of the antitrust law helps us to know clearly what kind of behavior constitutes a monopoly and what kind of conduct should be regulated by the antitrust law. In 1890, when the United States passed the Sherman Act, it began over 100 years of antitrust judicial practice. Its anti-monopoly illegal recognition principle has also been continuously adjusted and applied in practice.
