反倾销已成为制约我国出口企业发展的顽疾。企业层面反倾销应急体系的不健全、能力差、水平低甚至缺乏是反倾销败诉的重要原因。本文首先阐释了我国应急管理研究所面临的困境和非市场环境对企业应急管理带来的冲击,认为需将应急管理和非市场战略与企业内部控制相融合、在企业内部控制基础上嵌入应急管理的职能以确保应急体系建设落到实处,进而提出构建反倾销应急体系的构想。文章尤其强调出口企业发挥应诉主体地位,积极同政府、行业协会等利益相关方进行信息沟通、有效协同,以期实现市场战略和非市场战略的整合,构建“上下贯通、多方联动”的企业反倾销应急体系。
Anti-dumping has become a stubborn obstacle to the development of China’s export enterprises.
