在美国,通过正当程序条款,借助一系列的司法判例,宪法与刑事诉讼法紧密地融合在一起,形成了一体化的宪法与刑事诉讼法。这种模式形成的根本原因在于美国的法律文化传统、宪政体制及对基本权利的重视,它的最大特点在于将刑事诉讼权利宪法化,并在权利受侵害后能够加以救济。美国宪法与刑事诉讼法关系模式对一些国家,特别是日本的宪法与刑事诉讼法关系有较大的影响。
In the United States, the Constitution and the Code of Criminal Procedure are closely integrated through due process provisions and a series of judicial precedents to form an integrated Constitution and Criminal Procedure Law. The fundamental reason for the formation of this model lies in the legal and cultural traditions of the United States, its constitutional system, and its emphasis on fundamental rights. Its most prominent feature lies in the constitutionalization of the rights of criminal procedure and the relief of rights after being violated. The relationship model between the U.S. Constitution and the Criminal Procedure Law has a great impact on the relationship between the Constitution and the Criminal Procedure Law of some countries, especially Japan.
