韓非的法治思想提出了一個法主儒從的框架,而形成後世政治結構以及法典編纂的思想傳統。韓非集商鞅、申不害、慎到之法、術、勢的優點,對其短處加以批評、增益,從而成為法家的集大成者。本文要提出的是,集法家大成的韓非,其法治思想是容儒的。從法主儒從的法儒融合的角度來探討韓非思想,這和一般單純把韓非作為法家思想的集大成者,或認為《韓非子》書中有儒家思想的篇章即非韓非所作的論點,有所不同。
Han Fei’s idea of the rule of law proposed a framework of the rule of law and Confucianism and formed the ideological tradition of political structure and codification of later generations. Han Fei set Shang Yang, Shen not harm, cautious of the law, surgery, potential advantages, to criticize the shortcomings, gain, and thus become a master of law. What this article puts forward is that Han Fei, who put forth the great example of the rule of law, connived Confucianism. From the perspective of legal Confucianism and Confucianism, Confucianism and Confucianism explore the thought of Han Fei, which is not the same as that of non-Han and non-Han who generally consider Han Fei as the master of the legalists’ thought, or the chapter of Confucianism in Han Feizi’s book, Different.
