在涉外刑案中,对外籍犯罪嫌疑人的供述、文书等信息的翻译工作对案件侦查起着举足轻重的作用。精确、客观的译文是讯问及笔录顺利完成的必要前提,更能促使案件侦办取得进展,并为检察机关批准逮捕提供重要参考。但因翻译人员常对客观案情及犯罪嫌疑人主观表意立场了解不全面,因语境盲区致使译文不当、误导侦查的情况偶有发生。本文通过实例探讨涉外案件侦查翻译中语境盲区对译文的影响及其规避办法。
In foreign criminal cases, the translation of information such as foreign criminal suspects’ confessions and clerical documents plays an important role in the investigation of cases. Accurate and objective translations are the necessary prerequisites for interrogation and transcripts to be completed smoothly, and are expected to make progress in the investigation and prosecution of cases and provide an important reference for procuratorial organs to approve arrests. However, due to the fact that translators often do not understand the objective cases and the subjective opinions of criminal suspects, the improper translation due to the blind spots in the context leads to occasional misleading investigations. In this paper, the author explores the influence of contextual blind spots on translation in case-based translation of foreign-related cases and the ways to circumvent them.
