近几年来,作为“六害”之一的制造、贩卖、运输毒品犯罪活动日益猖獗。从甘肃省各级法院的收案情况看,1988年收案是1987年的1.8倍,1989年是1987年的4.7倍。这种犯罪活动,虽然经过多次查禁和集中打击,却仍在继续蔓延,社会各界强烈要求对制造、贩卖和运输毒品的犯罪活动给予狠狠打击。但是,由于刑法规定较原则,对具体的法律条文缺乏明确的司法解释,导致执法活动中认识不一致、量刑不统一的情况经常发生。据统计,我省近年来判处5年以上重刑的仅占案犯总数的5％左右,难以遏制制造、贩卖、运输毒品的犯罪活动。本文试图以制造、贩卖、运输
