受教育权是公民享有的一项宪法基本权利。由于现行法律规定的笼统,相关理论研究的滞后,受教育权法律救济不尽如人意。鉴于此,本文拟从受教育权范围界定入手,以非义务阶段的学生为研究对象,对既有的受教育权的法律救济途径进行梳理,对可行性的法律救济途径进行探索,以期对受教育权法律救济制度的健全有所裨益。
The right to education is a constitutional right enjoyed by citizens. Due to the general provisions of the current law and the lag of relevant theoretical research, the legal remedies for the right to education are not satisfactory. In view of this, this article intends to start with the definition of the scope of the right to education, with the non-obligation students as the research object, to sort out the legal remedies for the existing right to education and explore the feasibility of legal remedies, The remedy of legal remedies for the right to education is helpful.
