2007年4月24日,北京市第二中级人民法院就环球唱片有限公司诉北京阿里巴巴信息技术有限公司侵犯著作权邻接权一案作出了一审判决。被责为侵权的,是雅虎搜索引擎提供的mp3歌曲搜索服务,这一案件与近年来在媒体上沸沸扬扬的一系列搜索引擎被诉案件,在具体案情上并没有太实质性的区别,但是就判决结果来看,却把我们的目光集中引导到一个法律问题上:什么情况下,搜索引擎服务商应当被认定为对于侵权行为处于主观上“明知或应知”的状态?
