人民与宪法的关系是宪法学中极其重要的一个话题,也是全面理解民主内涵的关键。尽管在宪法框架之内行使民主权利的活动至关重要,但是,在一个理想的民主社会里,民主的内涵远比单纯地依据宪法进行投票选举更为丰富。在分析立宪时刻、常态以及例外状态下人民和宪法的不同关系时,对于内含于宪法秩序中的意志和理性之间的关联,德国著名宪法学家卡尔·施米特的相应观点有着重要的启示。
The relationship between the people and the constitution is an extremely important topic in constitutional law and the key to a full understanding of the connotation of democracy.
