汶川大地震造成大量区分所有建筑物损毁,灾后区分所有建筑物的重建刻不容缓。由于我国物权法上的区分所有建筑物重建制度缺乏可操作性,因而将严重影响我国地震灾区的灾后重建工作。我国应借鉴各国或地区区分所有建筑物重建制度的成功经验,根据我国社会发展的实际情况,建立重新简易表决制度,增设让售请求权,引入权利变换制度,完善住宅小区内区分所有建筑物的重建制度。
Wenchuan Earthquake caused a large number of distinction between all damaged buildings, all buildings after the disaster reconstruction urgency. Due to the lack of maneuverability of all the building reconstruction systems in China’s property law, it will seriously affect the post-disaster reconstruction in China’s earthquake-stricken areas. China should learn from the successful experiences of all countries or regions in distinguishing all building reconstruction systems and establish a simple referendum system according to the actual situation of social development in our country. The system of transfer of rights should be added to introduce a right transfer system so as to improve the distinction between all buildings in residential quarters Reconstruction system.
