风险时代生态环境危机时时侵扰着人类社会,已经威胁到人类的生存和可持续发展。环境立法作为应对风险的主要社会控制手段,唯具备正当性,才能发挥其应有的功能。目前,我国环境立法的主要问题在于缺乏公众参与和公众环境利益的表达,立法缺乏可操作性。因此,应该以利益表达的整合原则为基础,建立完善的环境立法公众利益表达制度,通过利益博弈的选择,从程序和实体上促进环境立法的正当性、合理性、实效性,从而更好地应对环境风险。
The crisis of ecological environment in the era of risk has always intruded on human society, threatening the survival and sustainable development of mankind. As the main social control method to deal with the risk, environmental legislation can only play its due function only with justification. At present, the main problems of China’s environmental legislation lie in the lack of public participation and the expression of public environmental interests, and the lack of operability of legislation. Therefore, we should establish a perfect public interest expression system of environmental legislation based on the principle of integration of interest expression. Through the choice of interest game, we should promote the legitimacy, rationality and effectiveness of environmental legislation from the procedure and entity, Respond to environmental risks.
