公案小说起源于中国,源于宋代的一种民间说唱艺术。从先秦两汉一些文献中的案例与史书中的“清官”传记中,可看出一些公案小说的端倪,可以说是公案小说的先导。到了宋代,民间说唱艺术盛极一时,刑事、民事案件激增,公案作品便大量产生,且种类繁多。可以说,宋代的公案作品是公案小说的早期。从明中叶到明末清初,出现了记载“清官”断案的长篇小说《包公案》、《海公案》、《三言两拍》等
