编辑同志:我丈夫1993年9月因公出差致残,经过劳动部门鉴定为伤残五级,所在单位1996年10月改制,2002年停产。从1996年10月至今,我丈夫就一直没有领过伤残抚恤金,养老保险和医疗保险单位也都没有给交。我们为此奔波了10年。现在,我们有两个问题请你们给予解答:第一,我丈夫的工伤补偿是按照1996年的《企业职工工伤保险试行办法》执行,还是按照2004年的《工伤保险条例》执行;第二,伤残抚恤金应补发到2002年单位停
Editor's Comrade: My husband was disabled on business trip in September 1993, and was identified as disabled by the labor department at grade five. The unit was restructured in October 1996 and was discontinued in 2002. Since October 1996, my husband has never received any disability pension, and pensioners and medical insurance companies have not given any payment. We are running around for 10 years. Now, we have two questions for you to answer: First, whether my husband's compensation for work-related injury is implemented in accordance with the Trial Measures on Work-Related Injuries Insurance for Workers and Workers of Enterprises in 1996 or in accordance with the Industrial Injury Insurance Ordinance of 2004; secondly, Disability pensions should be reissued to the unit in 2002
