本文认为 ,在民事诉讼中 ,管辖权之确定 ,以当事人起诉时为准。只要在起诉时 ,法院对某一民事案件拥有管辖权则其在整个诉讼系属中对该案件有管辖权。管辖恒定原则之确立不仅具有内在法理依据而且具有必要性。 This paper argues that in civil litigation, the jurisdiction is determined by the parties when the prosecution shall prevail. As long as the court has jurisdiction over a civil case at the time of prosecution, it has jurisdiction over the case throughout the litigation line. The establishment of the principle of constant jurisdiction not only has the inherent legal basis but also has the necessity.
