国有企业改制使其性质发生了改变,相应的也就带来了跨改制前后连续从事管理工作的人员,所实施的职务犯罪行为应如何适用法律的难题。针对这一难题,本文结合工作实际,对关于国企改制后管理人员性质、改制中职务犯罪的客体、犯罪数额的认定进行了简要的分析。
The nature of the restructuring of state-owned enterprises has changed. Correspondingly, it has brought about continual management of personnel before and after the system reform. How should the application of legal crimes be implemented? In response to this difficult problem, this article gives a brief analysis of the identification of the amount of crime with regard to the nature of the managerial staff and the duty crimes in the system reform after the restructuring of state-owned enterprises.
