随着市场经济的发展,许多商家将中医药传统标识用于自己的企业或者产品之上,使之成为其企业名称、商标或者产品包装装潢等。这种商业化使用将可能导致中医药传统标识被不当占有、中医药传统文化的损害以及市场的不正当竞争。然而,运用现有的《商标法》、《反不正当竞争法》、《企业名称登记管理规定》、《中国互联网络域名管理办法》和《广告法》等尚不能很好地阻止这种商业化使用。笔者认为,完全保护中医药传统标识和中医药传统文化,需要通过对中医药保护进行单独立法,禁止将中医药传统标识用于商业目的。
With the development of market economy, many merchants use the traditional Chinese medicine identification on their own enterprises or products to make them their business names, trademarks or product packaging and decorating. This commercial use will likely result in improper possession of traditional Chinese medicine marks, damage to the traditional culture of traditional Chinese medicine and unfair competition in the market. However, the use of the existing Trademark Law, Anti-Unfair Competition Law, Provisions on the Administration of Enterprise Name Registration, Measures for the Administration of Internet Domain Names in China, and the Advertising Law are not enough to stop such businesses Use. The author believes that the complete protection of the traditional Chinese medicine logo and the traditional Chinese medicine culture requires the separate legislation on the protection of traditional Chinese medicine to prohibit the traditional Chinese medicine logo for commercial purposes.
