随着社会主义民主法制建设的不断推进,听证制度已逐步进入我国的政务领域。它的确立与实施对于依法治国、建设社会主义法治国家具有重要的意义。自2000年3月《中华人民共和国立法法》出台后,听证已被越来越多的地方国家权力机关在行使立法权和监督权、决定权的过程中所采用。本文概述了听证制度的产生以及在我国的建立,并主要通过分析我国省级人大应用立法听证制度的情况,指出了听证过程中存在的问题,如制度缺失、功能错位、成本过高、效果欠佳、研究滞后等,同时提出了进一步改进和完善地方人大听证制度的建议,包括五个方面,即加强制度建设、降低听证成本、扩大听证范围、完善听证程序、注重听证结果等。
With the continuous promotion of the construction of socialist democracy and legal system, the hearing system has gradually entered the field of government in our country. Its establishment and implementation are of great significance to governing the country according to law and building a socialist country ruled by law. Since the promulgation of the Legislation Law of the People’s Republic of China in March 2000, hearings have been adopted by more and more local state organs in the process of exercising their legislative, supervisory and discretionary powers. This article summarizes the emergence of the hearing system and its establishment in our country. It also points out the problems existing in the hearing process, such as the lack of system, the dislocation of functions, the high cost and the inefficiency And lags behind the research. At the same time, it puts forward suggestions on further improving and perfecting the hearing system of local people’s congresses. It includes five aspects: strengthening system construction, lowering the hearing costs, expanding the scope of the hearing, improving the hearing procedure and focusing on the outcome of the hearing.
