今年1月1日,《劳动合同法》正式施行。作为我国第一部在法律层面上独立调整劳动合同关系的法律,一“诞生”就引发了一系列强烈的连锁反应,从华为公司“辞职门”事件到沃尔玛的裁员风波,抽象的劳动关系忽然变成了一个个鲜活的案例。不管是半遮半掩的规避,还是面对新法的惶恐不安,都会随着《劳动合同法》的正式施行迎刃而解。《劳动合同法》给现有劳动合同法律制度、用工制度带来了全新的变革与挑战,不管是用人单位,还是劳动者,都进入了一个新劳动合同时代。在新的劳动法制环境下,劳资关系的管理和协调是用人单位面临的一个重大问题,因此,作为用人单位,应该通过新法的实施来提升在劳动关系管理上的能力,进而构建和谐的劳动关系,提升竞争力。对劳动者来说,学习《劳动合同法》,了解并积极主张自己的权利,都是维护好自身合法权益必做的“功课”。随着《劳动合同法》的实施,我省进入劳动争议高发期,劳动争议案件将明显增多,加快劳动争议仲裁体系建设迫在眉睫。劳动保障部门应科学规划,认真落实应对措施,切实保证新法的平稳实施,维护劳动关系的和谐稳定。

For laborers, studying Labor Contract Law and knowing and actively advocating their own rights are all necessary tasks to safeguard their own legitimate rights and interests. With the implementation of the “Labor Contract Law,” our province has entered a period of high labor disputes and the number of labor disputes has increased significantly. It is imminent to speed up the construction of a labor dispute arbitration system. The departments of labor and social security should scientifically plan and conscientiously implement the measures to ensure the smooth implementation of the new law and maintain the harmonious and stable labor relations.
