历时22个月之久的“朱虹诉上海科技报社和陈贯一医生”案,虽因今年3月9日上海市中级人民法院的终审判决而告结束,但该案的发生以及社会各界在诉讼过程中表达出来的不同观点,说明其影响所及,已超出个案的范围。联系到目前大众传播媒介在宣传方面普遍存在的“灰色”现象,笔者感到,对公民的肖像以及肖像合理使用的范围和原则进行探讨,对新闻出版以及其他事业的发展和司法实践均有一定的现实意义。
