一、根据人民政府「发展生产、繁荣经济、公私兼顾、劳资两利」的方针,在私营工商企业中,为了便于劳资双方进行有关改进生产、业务与职工待遇各项具体问题的协商起见,在劳资双方同意之下,得设立劳资协商会讲的组织。二、劳资协商会议的组织,一般适用于雇用五十人以上的私人工厂商店;凡雇用五十人以下者,得根据本指示的精神与具体情况斟酌办理之。同时在同一城市的同一产业或行业中劳资双方均认为必要时,亦得设立该产业或行业的劳资协商会议。三、劳资协商会议篇劳资双方平等协商的机关,不负企业经营舆行政管理的责任。四、劳资协商会议之组成以由劳资双方代表机关分别选派同等数量之代表为原则(在企业单位中的协商会议,企业主或所委任之经理、本企业单位厂长舆工会粗织的主席应为当然代表),双方代表名额由双方协商规定之,一般以每方二人至六人为宜。五、叁加劳资协商会议之代表,应比较固定,双方各自选定代表后,应将代表姓名通知对方。但遇必要时,双方均有自行更 I.
