随着城市现代化的快速进程和我国城市规划理念的变革,“街区制”小区模式将成为我国住宅规划的新趋势。“街区制”小区政策的推行,必将造成传统住宅小区道路的公共化,这属于对小区业主区分所有权的法律限制,其法律性质不应属于财产权社会义务范畴,应构成公法上的管制性征收,因此,要求国家出台法律法规对其予以规制,这样才能实现小区财产权人的合法权益与社会公共利益之间的均衡。以财产权的社会义务理论为基础,以法释义学为分析工具,探讨住宅小区道路公共化的正当性基础,厘清管制性征收和财产权社会义务之间的法律边界,证成小区道路公共化的法律属性及其法律补偿。
