善意取得制度由来已久,且在物权的变动过程中起着重要作用。但我国相关的法律一直以来并没有明确的关于善意取得构成要件的规定,直到2007年《中华人民共和国物权法》的颁布才明确的规定了关于动产和不动产善意取得的构成要件。本文正是在这种环境下对物权法第一百零六条的规定进行分析、解释,来实现对善意取得制度的充分理解,掌握善意取得制度在物权转移过程中的应用。
Goodwill acquisition system has a long history, and plays an important role in the process of change of real right. However, the relevant laws in our country have not clearly stipulated the requirement of bona fide acquisition of constitutional requirements until the promulgation of the “Property Law of the People’s Republic of China” in 2007 which explicitly stipulated the constitutional requirements for bona fide acquisition of movable and immovable property. This article analyzes and explains the provisions of Article 106 of the Real Right Law under this kind of environment to realize a full understanding of the system of goodwill acquisition and to grasp the application of the system of bona fide acquisition in the process of transfer of real right.
