近代被害人补偿制度由功利主义法学家边沁提出,新西兰于1963年首次将该制度付诸实践,建立世界上第一个刑事被害人国家救助制度。1985年11月29日联合国大会通过《为罪行和滥用权力行为受害者取得公理的基本原则宣言》(以下简称《宣言》),使得对刑事被害人给予救助成为国际刑事司法的通行规则。
Modern victim compensation system was put forward by Bentham, a utilitarian jurist. In 1963, New Zealand put the system into practice for the first time and established the first state aid system for criminal victims in the world. On November 29, 1985, the United Nations General Assembly adopted the Declaration of Basic Principles of Justice for Victims of Crime and Abuse of Power (hereinafter referred to as “the Declaration”), rendering aid to criminal victims a universal rule of international criminal justice.
