网络技术的发展和应用,对于人们的工作与生活无疑是一把双刃剑。一方面,网络信息特有的时效性和广泛性,能够拓宽舆论监督的渠道,有利于法治建设的制度化与透明化;另一方面,网络信息传播的无序性和市场性,也给不法分子可乘之机,严重侵犯公民的合法权益和社会秩序。文章从对舆论监督与网络诽谤的定义出发,对现行法律法规中对两者界定的现状进行分析,为合理区分舆论监督与网络诽谤在司法实践中界限提供建议。
The development and application of network technology is undoubtedly a double-edged sword for people’s work and life. On the one hand, the timeliness and extensiveness of the unique network information can broaden the channel of public opinion supervision, which is conducive to the institutionalization and transparency of the rule of law. On the other hand, the disorder and marketability of network information dissemination also give criminals The opportunity to take a serious violation of the legitimate rights and interests of citizens and social order. Starting from the definition of public opinion supervision and network defamation, the article analyzes the status quo of the definitions of the two in the current laws and regulations, and provides suggestions for the reasonable distinction between public opinion supervision and online defamation in the judicial practice.
