引言一个行政决定的作出引发了相关民事争议的产生,或者民事争议出现后,行政决定介入到当中,这两种情况都会产生行政与民事争议的交织问题。该问题因其所涉及的程序与实体问题的复杂性,被学术界和实务界多所关注。何海波老师的“行政行为对民事审判的约束力”一文为研究该问题的较新成果,依笔者所见,亦是集大成之成果。 Introduction When the making of an administrative decision triggers the emergence of relevant civil disputes or the appearance of civil disputes, administrative decisions are intervened.
