对行政立法过程中低水平的普通公众参与的不满,导致学者们将希望寄托于信息技术的应用。然而,调查显示信息技术虽取得一定的效果,但并未产生重大的改变,制约公众参与的主要障碍并非技术上的因素。鉴于信息技术效果上的不确定性,电子化参与应作为传统参与方式的补充。为实现有效的公众参与,信息技术的应用须适当地嵌入行政管理的体制中,通过发展相应的评估标准,协助行政机关选择合适的技术手段。
Dissatisfaction with the low level of ordinary public participation in the administrative legislation process has led scholars to pin their hopes on the application of information technology. However, the survey shows that although information technology has achieved some results, it has not made any significant changes and the major obstacle to public participation is not a technical one. In view of the uncertainty of the effectiveness of information technology, electronic participation should complement traditional modes of participation. In order to achieve effective public participation, the application of information technology must be properly embedded in the administrative system and assist the executive authorities in choosing the appropriate technical means by developing appropriate assessment standards.
