目前,我国法学界对于在中央一级建立一个保障宪法实施的机构,基本上已达到共识,只在该机构的性质、地位、权限等问题上存有分歧;但对于如何在地方上具体保障宪法实施,进而在全国建立一套宪法保障机制,设想及论述尚属稀少。笔者不揣陋见,提出一些未必成熟的设想,供决策者和学界同仁参考。一、设计原则及各种模式利弊之比较在我国,设计建立宪法保障机构必须遵循以下四个原则:1.能够真正、有效地保障宪法实施。2.保证人民代表大会制度作为我国的根本政治制度、各级人民代表大会实行民主集中制、议行合一原则这一根基不被动摇。3.全国人民及决策者可以接受。4.具有可行性、可操作性。
At present, the legal profession in our country basically has reached a consensus on setting up a mechanism for guaranteeing the implementation of the constitution at the central level, and there are only differences on such issues as the nature, status and authority of the institution. However, the issue of how to guarantee the constitution at the local level Implementation, and then set up a nationwide constitutional safeguard mechanism, vision and discussion is still scarce. The author does not humble opinion, put forward some ideas may not be mature for policy makers and academic colleagues reference. First, the design principles and comparison of the pros and cons of various models In our country, the design and establishment of the constitutional safeguard agencies must follow the following four principles: 1. To truly and effectively protect the implementation of the Constitution. 2. To ensure that the system of the people’s congress, as the fundamental political system of our country, at all levels of the people’s congress, implements the principle of democratic centralism and the principle of the principle of the unity of the two nations will not be wavering. 3. People across the country and policymakers can accept it. 4. Feasibility, maneuverability.
