经济法研究中存在一个很大的问题就是过度的夸大了第三部门的作用。把带有社会自治性的第三部门完全视为可以独立于政府、市场的第三支力量。这支力量不仅公正,而且几乎无所不能企及,成为“大社会小政府”的治理核心。这种法思想嫣然已成为现代经济法的主流思维。本文从这种思维背后隐含的问题入手,从法源分析、中立性角度应用现代解构学等方法进行分析,导出了第三部门辅助性、非中立的实质。
One of the big problems in the study of economic law is the excessive exaggeration of the role of the third sector. The third sector with social autonomy is completely regarded as the third force that can be independent of the government and the market. This force is not only just but also almost invincible, becoming the core of governance of a “small government of large societies.” This idea of law has become the mainstream of modern economic law thinking. Starting from the implied problems behind this kind of thinking, this article analyzes the law from the source of law and neutrality by applying the methods of modern deconstruction, and derives the supplementary and non-neutral essence of the third department.
