自我国实行住房改革以来,房地产业逐渐成长为拉动中国经济增长的龙头产业,一升再升的住房价格,已经逐渐超出了普通百姓的承受能力。近来受全球金融危机的影响,房地产市场出现了低迷,打破了房地产开发商只赚不赔的局面,有的开发商甚至走到了破产的边缘。开发商破产,相关利益群体都会受到不同程度的损失,但其中购房者可能是损失最大的。本文结合我国的商品房预售制度和破产制度,探讨开发商破产后对购房者利益的保护。
Since the implementation of housing reform in our country, the real estate industry has gradually grown into a leading industry that drives China’s economic growth. A rising and rising housing price has gradually exceeded the affordability of ordinary people. Recently by the global financial crisis, the real estate market downturn, breaking the real estate developers earn no compensation situation, and some developers even went bankrupt. Developers bankruptcy, the relevant interest groups will be subject to varying degrees of loss, but home buyers may be the biggest loss. This article combines China’s real estate pre-sale system and the bankruptcy system to explore the developers after the bankruptcy protection of the interests of home buyers.
