2013年2月22日,贵州省物价局和四川省发展和改革委员会认定茅台和五粮液公司实施纵向价格垄断行为,并根据《反垄断法》第14条第2款的规定,分别对茅台酒销售有限公司处以2.47亿元罚款、对宜宾五粮液酒类销售有限责任公司处以2.02亿元罚款。该案成为《反垄断法》实施5年来首次对行业龙头企业实施重罚,但该案的法律思考与经济学思维的探讨并未随着案件的结束而终结。
On February 22, 2013, Guizhou Price Bureau and Sichuan Provincial Development and Reform Commission decided that Maotai and Wuliangye Co. should implement vertical price monopoly. According to Article 14, Paragraph 2 of the Anti-monopoly Law, they separately sold maotai liquor Co., Ltd. imposed a fine of 247 million yuan and imposed a fine of 202 million yuan on Yibin Wuliangye Liquor Sales Co., Ltd. The case became the first time in the past five years that the Anti-monopoly Law was implemented to impose heavy penalties on leading enterprises in the industry. However, the discussion on legal thinking and economic thinking in the case did not end with the conclusion of the case.
