歧视是世界各国普遍存在的现象,处于转型时期的中国,歧视现象大量出现并且具有许多自身特征,建立符合中国国情的反歧视法律规范对现代化进程中的中国有着重大的现实意义。本文从中国制定反歧视立法的必要性出发,分析了目前中国存在的歧视问题,并通过学习与借鉴各国的反歧视立法,分析了在经济法视野下反歧视立法的可行性,提出我国未来反歧视立法应从社会经济的实际情况出发,在立法模式、具体制度上应精心设计。
Discrimination is a ubiquitous phenomenon in all countries in the world. In the transition period of China, the phenomenon of discrimination has appeared in a large number and has many characteristics. The establishment of an anti-discrimination law and regulation that is in keeping with China’s national conditions is of great practical significance to China in the process of modernization. Based on the necessity of enacting anti-discrimination legislation in China, this article analyzes the existing problems of discrimination in China and analyzes the anti-discrimination legislation from the perspective of economic law through studying and drawing lessons from anti-discrimination legislation of all countries, Discrimination legislation should be based on the actual social and economic conditions, in the legislative model, the specific system should be carefully designed.
