中国长期以来是一个行政主导的国家,对效率的追求往往遮蔽对民主价值的回应,为了体现国家治理的民主化要求,探讨从“非强制性行政”概念出发来构建行政民主就显得非常必要。从基于“非强制行政”所进行的行政改革进程看,为从“控制行政法学”向“平衡行政法学”的转变也提供了诸多可能性。为了进一步完善行政民主:行政自律是行政民主的前提,行政国家自身要尽可能自律,反思平衡和自我限权,改变过去简单粗暴的强制行政作为;处理好政府与公民之间新型关系,主动开放和迎接公民对行政行为的监督;并积极推进非强制性行政行为的制度化,落实好行政民主。
China has long been an administratively dominated country. The pursuit of efficiency often obscures its response to democratic values. In order to reflect the democratization requirements of state governance, it is quite unusual to explore how to construct administrative democracy from the concept of “non-compulsory administration.” necessary. From the perspective of the administrative reform based on “non-mandatory administrative ”, there are many possibilities for the transition from “controlling administrative law” to “balancing administrative law ”. In order to further improve administrative democracy, administrative self-regulation is the premise of administrative democracy. Administrative countries themselves should try to be as self-disciplined as possible, reflect on balance and self-limiting powers, and change simple and rude acts of compulsory administration in the past. To handle the new relations between the government and citizens and take the initiative to open up And to welcome citizens to supervise administrative acts; and actively promote the institutionalization of non-mandatory administrative acts, and implement good administrative democracy.
