买卖房屋应办理房产过户手续。我国《城市私有房屋管理条例》第9条第1款明确规定:“买卖城市私有房屋,卖方须持房屋所有权证明和身份证明,买方须持购房证明信和身份证明,到房屋所在地房管机关办理手续”。《城市房地产管理法》第6条规定:“房地产转让或变更时,应当向县级以上地方人民政府房产管理部门申请房产变更登记。”从这些规定可以看出,房屋买卖是一种法律行为,它以当事人到房屋所在地房管机关办理房产变更登记手续作为必要的成立条件。如果当事人没有办理这一手续,其买卖行为就没有法律效力。赃车买不得。最高人民法院、最高人民
