【裁判要旨】由于海上货物运输的特殊性,托运人和承运人是签订运输合同的当事人,而收货人往往只是提单持有人。提单经过多次背书转让后发生货损时,识别承运人主要依据三处标识,分别是在提单抬头印制的船运公司名称、处在提单右下角的签名以及提单背面的光船租赁条款或承运人识别条款。司法实践中,提单抬头一般要结合提单右下角的签名才能识别承运人,而提单背面的识别条款一般不作为识别承运人的依据。简而言之,提单右下角的签名是识别提单承运人的重要证据,而该处签名的不同表述或提单上的租约并入条款将直接影响提单承运人的识别。
