现代社会劳动关系领域,商业秘密的保护主要通过竞业限制来完成。竞业限制包括在职竞业限制和离职竞业限制。本文在阐述竞业限制概念体系的基础上,分析在职竞业限制和离职竞业限制的基本理论问题,并提出改进并完善我国劳动关系领域中竞业限制的建议。
In the field of labor relations in modern society, the protection of trade secrets is mainly achieved through non-competition. Non-competition restrictions include in-service non-competition restrictions and non-competition restrictions. Based on the concept system of competitive restriction, this paper analyzes the basic theoretical issues of competitive restriction and separation of competing on the job, and puts forward some suggestions to improve and perfect the competitive restriction in the field of labor relations in our country.
