海上运输是国际贸易的主要运输方式,而在海运中,提单往往扮演着重要的角色。承运人凭单放货是国际贸易中的一项基本原则。但在实践中,承运人“无单放货”的现象还是屡见不鲜。文章首先介绍了无单放货概念与构成,结合实践提出确认无单放货法律责任的性质在解决无单放货现象中的必要性;接着分析了关于承运人无单放货法律责任的性质目前在理论界与实务界存在的三种观点;最后,对《最高人民法院关于无单放货的规定》中对承运人无单放货责任性质的部分进行了简单的评析;并对此提出几点建议,希望为中国航运事业的发展贡献一份绵薄之力。
Maritime transport is the main mode of transport for international trade, and billboards often play an important role in maritime transport. Carrier voucher delivery is a basic principle in international trade. However, in practice, the carrier “no bill of lading ” phenomenon is still uncommon. The article first introduces the concept and composition of the delivery without the bill of lading and puts forward the necessity of confirming the legal liability of the bill of lading without releasing the delivery of goods without the bill of lading according to the practice. Then it analyzes the nature of the legal liability of the carrier without the bill of lading At present, there are three kinds of viewpoints existing in theorists and practitioners. Finally, a brief comment is made on the part of the carrier that is not responsible for the delivery of the goods in its original place in the Provisions of the Supreme People’s Court on the Delivery of Goods without B / L. In addition, A few suggestions, I hope for the development of China’s shipping industry contribute a modest.
