美国联邦巡回上诉法院(CAFC)在2003年Ram bus案中关于披露义务的裁决,指出了标准化组织专利政策信息披露相关规定存在的模糊性。该裁决有助于敦促标准化组织完善其政策。但标准化组织成员在专利信息披露实质性问题上的回避做法,使标准化组织未能实质性地改进其专利政策。CAFC的裁决进一步明确了标准化组织专利政策的局限性,使其在实践中面临更大的不确定性。不过,从更长远的角度说,CAFC的裁决有助于各方加深对现行标准化组织专利政策局限性的认识,并积极寻求解决问题的途径。
The ruling of the Federal Circuit Court of Appeal (CAFC) on the disclosure obligations in the Ram bus case in 2003 pointed out the ambiguity of the relevant provisions of the standardization organization’s patent policy on information disclosure. The ruling helps to urge the standardization organization to improve its policies. However, the evasion of members of the standardization organizations on substantive issues of patent information disclosure made it impossible for the standardization organizations to substantially improve their patent policies. The CAFC ruling further clarified the limitations of the standardization patent policy and made it more uncertain in practice. However, in the longer term, the CAFC’s ruling will help all parties to deepen their understanding of the limitations of the existing standardization patent policy and actively seek ways to solve the problem.
