人力资本是一个从经济学中衍生出来的概念,对人力资本理论的研究在经济学领域已有相当的规模。但与经济学界所取得的研究成果相比,法学界对人力资本理论的研究还存在很大的差距,尤其对人力资本出资中存在的法律问题研究的更少。在如今经济全球化的背景下,出资形式已经呈现出多样化趋势,随着科学技术的发展,人力资本要素对经济增长所起的重要作用已经被人们所认同。因此,对人力资本出资合理性问题的探讨显得十分的现实和必要,尤其是对人力资本出资适格性的研究,将对我国法律制度的发展和完善有所裨益,也将十分有益于我国经济的发展。
Human capital is a concept derived from economics. The study of human capital theory has a considerable scale in the field of economics. However, compared with the research achievements made by economists, there is still a big gap between the jurisprudence research on human capital theory and research on the legal problems in human capital investment. Under the background of economic globalization, the form of investment has shown a diversified trend. With the development of science and technology, the important role of human capital in economic growth has been recognized.
