当前建筑业竞争激烈,随着建筑市场逐渐的规范,施工企业在合同管理方面仍然存在诸多风险,合同条款涉及面广,受到市场经济、法律、人的行为等多种因素影响,因为建筑工程施工合同价后成交,其远期交割的特点决定了建筑行业的高风险性。企业在强化工程项目管理的同时,必须加强施工合同的管理。本文拟从施工合同存在风险,提出相应的对策,力争避免或减少对企业的影响。
Currently, there is fierce competition in the construction industry. With the gradual standardization of the construction market, there are still many risks in the contract management of construction enterprises. The contract clauses involve a wide range of issues and are affected by various factors such as market economy, law and human behavior. Contract price after the transaction, the characteristics of its forward delivery determines the high risk of the construction industry. Enterprises to strengthen project management at the same time, we must strengthen the management of construction contracts. This paper intends to risk from the construction contract, put forward corresponding countermeasures, and strive to avoid or reduce the impact on the enterprise.
