国内对行政诉讼受案范围的研究,基本局限于对某类行政行为是否属于或者应否纳入司法审查范围的分析之上,忽视了受案范围最基本问题——“行政”界限的厘定。当今对行政的界定有两个重要趋势:从形式标准向实质标准转化,从权力标准向公共因素标准转化。面对我国政府职能转变的加快,国内对行政的界定采取权力来源标准的状况必须加以改变。现阶段可以将垄断性组织、成员无选择权的组织的管理行为先纳入行政诉讼范围。
The domestic research on the scope of the administrative litigation cases is basically confined to the analysis of whether certain kinds of administrative behaviors belong to or should be included in the scope of judicial review, ignoring the determination of the “administrative” boundary, which is the most basic problem in the scope of the case. There are two important trends in the definition of administration today: from formal standards to substantive standards and from power standards to public factor standards. Faced with the acceleration of the transformation of the government’s functions in our country, the status quo of adopting a standard of power source in the domestic definition of the administration must be changed. At this stage, the monopoly organizations and the organizations that have no choice of members can be included in the administrative litigation scope first.
