市场经济体制要求以市场作为人力资源配置的基础性手段。市场运行过程中,劳动力供求双方的市场风险、利益取向、激烈竞争等,都会给劳动关系带来一些新的问题,出现新的矛盾。如果没有强有力的法律作保障,就很难避免市场缺陷形成的漏洞对劳动关系双方权益的侵犯。市场经济是法制经济,市场拒绝任何超越于法律之上的权利。市场经济条件下,劳动关系主体的权利、义务、行为、劳动力市场秩序,都必须由法律来建立、规范和维护。
